Our property litigation team is nationally recognised as one of the leading groups in the UK. This specialist team of 12 lawyers sits with our property group, working alongside property, property finance, planning and environmental lawyers. They are among 300 specialist litigators within Pinsent Masons who have developed a distinctive, transparent dispute resolution approach. Working with our in-house forensic accountants we set out risk and reward for clients at the outset, agree a course of action and budget, and project manage our work to achieve agreed results and price.
Whilst we generally regard litigation as a last resort, avoiding litigation is not always possible or appropriate. We have extensive experience of property disputes proceeding to final hearings in the County Court, High Court, Court of Appeal, House of Lords, European Court of Justice, European Court of Human Rights, Leasehold Valuation Tribunal, Lands Tribunal and at arbitration.
The property litigation team has an outstanding record of success at trial having been successful (or negotiated successful compromises) in over 90% of the cases which have progressed to trial or appeal. Pinsent Masons has also been at the forefront of the development of Alternative Dispute Resolution. We are regularly involved in expert determinations, mediations and references of business lease renewals to the PACT scheme.
